Call to Action, UPDATED NOVEMBER 3

AMT Credit Fairness and Relief Act, HR 3861, added as an amendment to the Temporary Tax Relief Act of 2007, HR 3996!!!

Two exciting events have occured over the last couple of weeks. First, HR 3861 was introduced October 16th by the Rep. Van Hollen (with Rep. Sam Johnson as the lead Republican cosponsor, and Rep. Neal and Rep. Ramstad as original cosponsors). Second, HR 3861 was added as an amendment to HR 3996 on November 1st.

This is significant as HR 3996 has a very good chance of passing before year-end. Why? HR 3996 is unofficially "Tax Extenders". Each year, Congress passes a bill that extends certain tax breaks, similar to last year's Tax Extenders that got HR 3385 passed (our Phase I victory).

HR 3861 will :
  • Remove income caps completely.

  • Accelerate the refund period to 2 years (vs. 5)

  • Abate interest and penalties for outstanding liabilities related to ISO-AMT

  • Convert interest and penalties that people may have paid to date into AMT credits that are also refunded.
HR 3861 full bill language is available here.

Stay tuned for HR 3996 bill language as it becomes available...

MESSAGE #1, Democrat and last year's HR 3385 co-sponsor message of support for HR 3861 and HR 3996

Dear [Representative]:

I am happy to report that we made an important step forward toward resolving the ISO AMT crisis, with the AMT Credit Fairness and Relief Act H.R. 3861 introduced on October 16th by Rep. Van Hollen, with Rep. Sam Johnson as the lead Republican cosponsor and Rep. Neal and Rep. Ramstad as original cosponsors.

This legislation will:

  1. Ensure no employee has to pay a disproportionate tax based on phantom income, but that everyone pays a just and proportional tax on income actually received.

  2. Employees who have not been able to pay the grossly disproportionate tax, are relieved of these unintended liability, interest and penalties.
Attached is the press release from Representative Van Hollen's office on the Bill introduction. [Attachment]

Further, HR 3861 has been added as an amendment to HR 3996, The Temporary Tax Relief Act of 2007 on November 1st.

[Feel free to write about your situation here, but keep it concise, respectful, and humble.]

Thank you so much for your support for and cosponsorship of the last year's HR 3385 (Phase 1 relief legislation). We would greatly appreciate your continued support for Phase 2 of this effort. Please vote yes for HR 3996 with our provision included when it reaches the House floor. And please co-sponsor HR 3861. Your support will finally resolve the situation for the many families in your district. Please don't hesitate to give me a call or email if you have any questions or would like additional information.

Thanks again for all that you do for your constituents!
